Chapter 7 representation

Chapter 7 bankruptcy attorney in Sacramento

Chapter 7 can discharge eligible unsecured debt without a repayment plan, but income, prior filings and property determine whether it fits. Eric L. Sayre reviews those issues and represents you through the filing process. Our straightforward-case attorney fee is $1,500, with court and course charges in addition.

Will Chapter 7 erase all my debts?

No. A discharge addresses personal liability for qualifying debts. Certain obligations survive, and a lien may remain on property even when personal liability is discharged.

Common debts to discuss with your attorney
DebtTypical issue to review
Credit cards, medical bills and personal loansOften dischargeable, subject to exceptions such as fraud.
Child or spousal supportGenerally survives discharge.
Taxes and student loansSpecial rules apply; discharge is not automatic.
Mortgage or car loanA lender's lien and the arrangements needed to keep collateral require separate review.

What disqualifies someone from Chapter 7?

Prior case dates, counseling requirements and means-test results can affect eligibility or discharge. Being above California's median income does not automatically rule out Chapter 7: a further expense calculation may be required.

The Sacramento Chapter 7 requirements guide includes the current income table, a six-month income example and the Eastern District document checklist.

Can I keep my house, car and bank balance?

That depends on ownership, equity, available exemptions and secured-loan obligations. A trustee may sell nonexempt property. There is no single safe bank-balance amount that applies to every filer.

How do California exemptions affect that decision?

Eligible California filers generally compare the exemption systems under CCP sections 703 and 704. One emphasizes a flexible wildcard; the other includes a larger homestead protection. Residence history and the full asset picture matter. We review the applicable system before preparing your schedules.

Example: equity is different from the loan balance.

A car worth $15,000 with a $12,000 loan has $3,000 of equity before other adjustments. Protecting that equity and deciding how to handle the car loan are separate questions. This example does not determine whether a particular car is protected.

If you need time to catch up missed secured payments, compare keeping property through Chapter 13.

How long does Chapter 7 take?

  1. Prepare and review

Gather records, complete required counseling and review the petition with your attorney. Preparation time depends on the records and issues in your case.

  2. File and respond to the trustee

The court opens the case. A stay usually pauses most collection; exceptions and prior cases can change its effect. Follow the notices and document requests in your case.

  3. Attend the meeting and complete education

We prepare you for the trustee's meeting. Follow your meeting notice for attendance and identification requirements, then complete the required debtor education.

  4. Discharge and case administration

A routine discharge often occurs about 3–4 months after filing. Asset administration or disputes can continue longer; discharge and closing are different events.

How much does a Chapter 7 lawyer cost in Sacramento?
