Foreclosure and bankruptcy
Can bankruptcy stop foreclosure in Sacramento?
A bankruptcy filing can pause many foreclosure actions when the automatic stay applies, but it does not erase a mortgage or make future payments affordable. Your sale date, prior bankruptcy cases, loan status and budget affect which options remain. Get the exact date from your notice and seek case-specific advice promptly.
What if a foreclosure sale is already scheduled?
Read the notice of default, notice of sale and any court papers. Record the date, time, trustee and current mortgage status. Contact an attorney quickly; do not rely on a generic number of days because the available response depends on the documents and any prior case.
A bankruptcy petition may trigger an automatic stay, subject to statutory exceptions and prior-case limits. A filing draft, eSR account or consultation request does not pause a sale. Confirm that a case has actually been filed and get advice about notifying the trustee and servicer.
What options might help avoid foreclosure?
| Option | Question to answer |
|---|---|
| Contact the mortgage servicer | Is a loss-mitigation review or repayment arrangement available, and what deadlines apply? |
| Housing counselor or legal aid | Can a HUD-approved counselor or local legal resource help review the documents? |
| Chapter 13 | Can the household fund regular mortgage payments plus arrears and plan obligations? |
| Sale, transfer or another negotiated outcome | What timing, equity, tax and deficiency issues need advice in this specific situation? |
Bankruptcy is one path to evaluate, not a substitute for checking the servicer's process, the notice and the household's ability to pay.
Can Chapter 13 help me keep my Sacramento home?
Chapter 13 may allow eligible homeowners with regular income to cure mortgage arrears over a plan while resuming ongoing mortgage payments. The household must also meet plan requirements and cover living expenses. The sale pause alone does not solve the missed payments.
Illustration: arrears and ongoing mortgage
If a household has $18,000 in arrears, dividing that amount evenly over 60 months yields $300 per month for arrears alone. If the ongoing mortgage is $2,000, those two items total $2,300 per month before trustee charges, attorney fees, other required debts, property costs and living expenses. This arithmetic is an illustration, not a proposed plan or a result prediction.
See the full Chapter 13 budget and payment example. If the regular mortgage is not affordable, spreading arrears does not fix that problem by itself.
What should I bring to a foreclosure consultation?
- Notice of default and notice of trustee's sale, if received
- Recent mortgage statement and payment history
- Any servicer letters or loss-mitigation decision
- Household income and monthly expenses
- Prior bankruptcy case numbers and dismissal dates
Do not wait to assemble every record before calling about an imminent sale date. The first priority is to identify the deadline and whether a filing route could apply.
