What we collect
From the screening form: your county, household size, stated household income, answers to several yes/no questions, and your name, email, and optional phone number. The screening form does not ask for and should never be used to send a Social Security number, date of birth, or account number.
From clients who engage us: the financial information required to prepare a bankruptcy petition — identifiers including your Social Security number, income and employment records, tax returns, asset and debt schedules, bank statements, and creditor information. This is collected only through our secure document portal or in our office, never by email or through a web form.
Information you give us after we sign a fee agreement is protected by the attorney-client privilege and by our duty of confidentiality under California Business and Professions Code § 6068(e). Information submitted before an engagement begins is not privileged — see our legal notices.
How we use it
Solely to evaluate your inquiry, communicate with you, and represent you if we are engaged. We do not sell personal information. We do not share it with lead generators, marketing partners, or third-party advertisers.
Who we share it with
Only with service providers that host or transmit the data under contract, and only as needed to deliver the service; and where required by law, court order, or subpoena. Bankruptcy filings themselves become part of the public record of the court, with the exception of information the rules require to be redacted.
How long we keep it
Client files are retained in accordance with our file retention policy and the California Rules of Professional Conduct, then securely destroyed. Screening submissions that do not become engagements are deleted on a routine schedule. We also retain a limited record of inquiries for conflict-checking purposes.
Security
Data is transmitted over TLS and stored encrypted at rest, with access limited to personnel who need it. No system is perfectly secure, and we do not claim otherwise.
Your California privacy rights
California residents have rights under the California Consumer Privacy Act as amended by the CPRA, including the right to know what personal information we have collected, the right to request deletion, the right to correct inaccurate information, and the right to limit use of sensitive personal information. We do not sell or share personal information as those terms are defined by the statute. To exercise a right, contact eric@bankruptcylawca.com. We will not discriminate against you for exercising one.
Because we handle financial information, some records may also be subject to the federal Gramm-Leach-Bliley Act and its implementing rules.
Cookies and analytics
This site uses no advertising cookies and no cross-site tracking. Any analytics we add will be privacy-preserving and disclosed here.
Children
This service is not directed to anyone under 18 and we do not knowingly collect information from minors.
