Urgent filing guide
Emergency bankruptcy filing in Sacramento
If you have a sale, garnishment or repossession deadline, call a bankruptcy attorney with the exact date and the notice in front of you. A bankruptcy case generally begins when a petition is filed, but an automatic stay has exceptions and can be limited by prior cases. A court filing tool or saved draft is not the same as a filed case.

What should I do if a creditor deadline is close?
Confirm the deadline
Read the entire notice and record the sale or action date, time, creditor and contact number. If you have a foreclosure sale notice, bring it and a current mortgage statement.
Gather key case information
Bring government identification, income and bank records, a list of debts, property details, prior bankruptcy case numbers and any court or sheriff notices. Do not delay an urgent call while collecting every document.
Check eligibility and stay issues
A prior case, support debt or the kind of collection can affect the stay. Counsel needs to know about earlier filings and dismissals before assessing timing.
Confirm the case was actually filed
Ask for confirmation from the court or your attorney. Preparation, uploading a draft or requesting a consultation does not establish a bankruptcy case by itself.
Can I use eSR for an emergency bankruptcy?
The Eastern District says its eSR system is not intended for emergency filings. eSR is a document-preparation system; a draft or submission is not a filed petition and does not itself create a case number or automatic stay. For an immediate deadline, read the court's current instructions and get legal help about the filing route.

Does Sacramento have an emergency filing packet?
The Eastern District publishes an emergency filing packet for individuals and a Chapter 7 checklist that describes what must be filed initially and what follows within set deadlines. The packet can be incomplete by design. It does not mean that every missing form or deadline is waived.
Read the official Chapter 7 checklist, the current instructions for your chapter and the Sacramento clerk's office hours and access information. Confirm current procedures with the court before traveling; office hours and filing channels can change.
What happens to collection when a case is filed?
The automatic stay generally starts when a petition is filed. It can pause many collection actions, including a scheduled foreclosure sale, but exceptions apply and some creditors may ask the court to lift the stay. It does not erase mortgage arrears or make an unaffordable home payment sustainable by itself.
Some child or spousal support collection continues. If one or more bankruptcy cases were dismissed in the prior year, the stay may be limited or may not arise automatically. A completed sale, an existing order or another statutory exception can change the result.
How much does an emergency filing cost?
There is no special lower court filing price simply because a filing is urgent. The Eastern District's published fee schedule lists $338 for Chapter 7 and $313 for Chapter 13, checked October 1, 2026. An eligible individual may ask for installments; a Chapter 7 filer who meets the standard may request a waiver. See fees and payment options.
